New law in place for competency attainment programs in jails. Statute 611.46. What are other jails doing or is anyone dealing with this yet? I honestly am not aware of what a jail based competency program looks like. We typically await the outcome of the Rule 2O process and placement into a facility if ordered. Due to the lack of beds it is not uncommon for us to experience delays much like you describe as many of those placements are determined by most immediate need. If anyone else knows of any other programming I am interested.

We are lucky enough to have our 2 social workers assigned in the Olmsted ADC to help. They make calls, pull strings but many of our people sit past the time frames as well. I'm no expert, but from what I am told there is no one who has a jail-based competency attainment program and you would need to get certified by the board in order to start one. So.... you may want to buckle up because I don't think there's any place for them to go. So the 90 day rule is pretty much a mute point. I don't think they have any capacity to even try to be compliant with it at this point. The law makers are working on it but we know how fast that wheel turns. Until they can get more AMRTC's and St. Peters built or put some serious effort into a way to provide "jail-based competency attainment programs" were stuck. If you have 1 detainee and Olmsted has 3 sitting past 90 days, think how many Hennepin and Dakota have. :-) Good luck folks. Keep fighting the good fight. I said "90 day rule" but I think its actually 48 hours.

We also have a social worker assigned to the jail and he takes care of this. We did just drop one off at AMRTC only 3 weeks after being found incompetent. I think that's a new record!
